Analysis | The Commission stresses that when parents are divorced or otherwise seperated, it is in the interest of the child to award custody to one of the parents in the interest of the psychological well-being of the child. Hence its reference to health and morals. The Commission applies the same reasoning with regard to the right to access; the father is allowed to spend one weekend per month with his child. Finally, the Commission finds no evidence of a discriminatory (Article 14 ECHR) decision by the national authorities on the ground of his nationality (Greek). |
